Welcome to The Art of Drawing and Design! Although this will be a (online/in-person/hybrid in-person/online) course, we will be recreating the collaborative atmosphere of a real studio. I will teach hands on classical/structural and proportional figure drawing information, the relationship between human designs to cartoon/fantasy character designs, and their relationship to and the designing of locations
Our classes will be recorded and made available for viewing on YouTube and other streaming services. Accordingly, by participating in the course, you agree to be recorded; if you are participating online you can turn your camera off at any time if you don’t wish to be seen, but to participate in the class, we’ll have to be able to hear your voice and see any material (drawings, story ideas, dialogue, etc.) that you submit. In addition, you agree that Rich Arons (“I”, “me”, “my”) will own the audio-visual recordings of the course (including your participation), and that I (and my licensees, distributors and assignees) will have the exclusive right to use your name, likeness and voice as it appears in such recordings in all media, throughout the world, and in perpetuity, in connection with the distribution and promotion of the course.
You further agree that I will own any written or other fixed material (stories, sketches, drawings, in-character voice recordings) (“Works”) developed or created during course sessions by you or by any other student. Therefore, you hereby irrevocably assign to me all right, title and interest you may have, under U.S. Copyright law or under other applicable law, in any Works you submit during course sessions.
You acknowledge that you are not entitled to any monetary compensation for your appearance in the recordings of the course or from the use of any Works created by you during the course, and you waive any claim to payments or any other form of compensation on account of such participation or from the Works.
You also recognize the possibility that material that you develop outside of the course but which you share with me or other students may be identical with or similar to material that has been independently created by me or other sources. If you believe that your material is legally protected (via Copyright registration or otherwise), you should let me know (and make sure you tell anyone else you share such material with) before sharing.
You understand that the process of creating humorous material may result in drawings, comments or statements being made by me or other students which you find offensive, hurtful…or worse, not funny. You agree to waive any claims you may have as the result of hearing or seeing any offensive, hurtful or unfunny drawings, comments or statements and you agree not to institute any action based thereon.
You agree to release and hold harmless me (and his employees, agents or assigns) and any other students (with me, the “Released Parties”) from any and all claims, damages, liabilities, losses, expenses (including attorneys' fees) and causes of action whatsoever relating to your participation in the course, including but not limited to, any claims for defamation; invasion of privacy; and infringement of copyright, right of publicity or other rights. You hereby expressly waive all rights under Section 1542 of the California Civil Code and any similar law of any other state or territory of the United States of America. Such section reads: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”
This Agreement (i) constitutes our entire agreement; (ii) supersedes all prior agreements between us; (iii) may be amended only by written instrument signed by both parties; and (iv) shall be binding upon your heirs, executors, administrators and successors.
